Wichtige Änderungen im australischen Einwanderungsrecht

Gestern wurden Änderungen im General Skilled Migration Stream vom Department of Immigration and Citizenship verkündet. Mit Datum 08/02/2010 wurde die MODL Liste ersatzlos gestrichen. Im Laufe diesen Jahres soll eine neue SOL (Skilled Occupation List) die bisherige, gestrichene MODL sowie die Critical Skills List (CSL) ersetzen.

1. Revocation of the Migration Occupations in Demand List (MODL)

Yesterday, February 8th 2010, it was announced by the Minister for Immigration and Citizenship that the current MODL has been revoked

The revocation of the current MODL will not affect those who at the date of announcement (08.02.2010):

  • Hold a Skilled – Graduate (Subclass 485) Visa or have a pending subclass 485 application and are yet to apply for a permanent or provisional General Skilled Migration (GSM) Visa, or
  • Have lodged a GSM before 08.02.2010 / Have a pending GSM Visa application.
  • Applicants sponsored by an Australian employer.

The revocation of the current MODL will affect:

  • Those who are currently undertaking study in a MODL occupation as you will not be able to claim MODL points when you lodge your GSM application after 08.02.2010

2. General Skilled Migration (GSM) Points Test Review

The Department of Immigration and Citizenship (DIAC) has announced that there will be a review of the current Points Test that applies to GSM visas.

The GSM Points Test Review will be undertaken in the first half of 2010.

It is not known at this stage if the government will make changes to the GSM Points Test.

3.   Changes to the Current Skilled Occupation List (SOL)

The government is replacing the current Skilled Occupation List (SOL) with a more ‘targeted list of occupations’.

The new list by Skills Australia is expected to include managerial, professional, technical and trade occupations.

It is expected that the new SOL will be announced by 30th April 2010 and take effect from mid 2010. The new SOL will apply to ALL new GSM applicants from mid 2010 (exceptions apply).

When the new SOL list is introduced, the Critical Skills List (CSL) will be revoked.

4. Changes to Priority Processing

The Minister for Immigration and Citizenship has set new priority processing arrangements for certain skilled migrants.

These will apply to visas from 8th February 2010. The current highest priority applications will be from people who are employer sponsored under Employer Nomination Scheme (ENS) and Regional Sponsored Migration Scheme (RSMS).
